The Federal Staffing Rule That Protected Nursing Home Residents Is Gone! Here's What That Means for Your Family

For about a year and a half, families researching nursing homes had something they'd never had before: a federal law guaranteeing a minimum level of staffing. As of February 2, 2026, that protection no longer exists and most families haven't heard the news yet.

What Actually Happened

In 2024, the Biden administration finalized a rule requiring every Medicare and Medicaid-certified nursing home to provide at least 3.48 hours of direct nursing care per resident per day, including a registered nurse on-site 24 hours a day, seven days a week. It was the first national minimum staffing standard of its kind.

On December 3, 2025, the Centers for Medicare & Medicaid Services issued an Interim Final Rule officially withdrawing that standard, effective February 2, 2026. There is currently no federal floor requiring a minimum number of staff per resident in a nursing home.

Why This Matters More in Texas

Before this rule was even rescinded, Texas was already one of the lowest-staffed states in the country for nursing care hours per resident among the bottom five nationally, according to state payroll analysis reported by New Mexico In Depth. Removing the federal floor doesn't create a new problem in Texas so much as it removes the only mechanism that was pushing understaffed facilities toward improvement.

What Researchers Say Is at Stake

Staffing levels aren't just a paperwork issue they connect directly to resident safety. Research summarized by the Economic Policy Research group found that lower nursing home staffing rates are associated with more pressure sores, more urinary tract infections, more falls requiring hospitalization, and higher use of sedatives to manage residents who aren't getting enough hands-on attention. Separate research from the University of Pennsylvania estimated the now-rescinded standard could have prevented roughly 13,000 deaths a year nationwide had it stayed in place.

Why This Is Pushing Families Toward Smaller Homes

With no federal minimum in place, staffing levels at any given facility now come down entirely to that individual facility's own choices and, for larger operators managing hundreds of beds across multiple locations, staffing is usually the first place costs get cut when budgets tighten.

This is exactly why families are increasingly choosing small, licensed personal care homes over large facilities. A home caring for six to eight residents doesn't need a federal mandate to maintain a high staff-to-resident ratio it's built into how the home operates every single day, by design, not by regulation.

• Ask any facility directly what their current staff-to-resident ratio is, day and night don't assume it matches what it was before February 2026

• Ask how many residents each caregiver is responsible for during an overnight shift

• Don't rely on a facility's marketing materials ask to see staffing in action during your tour

• Consider a small residential home, where staffing ratios are typically high by structure, not by a rule that can be repealed
